Acceptable use Policy

  1. Use of Services
    1. IOHOST reserves the right to suspend or cancel a customer’s access to any or all Services provided by IOHOST , where IOHOST decides that the account has been inappropriately used. IOHOST reserves the right to refuse Services and/or access to its servers to anyone.
    2. IOHOST offer unlimited web space and bandwidth with some account types. By this, we mean unlimited space for legitimate web site content and bandwidth for visitors to view it. All files on a domain must be part of the active website and linked to the site. Sites should not contain any material which does not comply with our content guidelines (see section 3).
    3. IOHOST provides unlimited, burstable bandwidth and Burstable RAM with some of the services and for these resources we require that you do not continuously use an unreasonable excess of such resources. Use of them in a temporary, burstable fashion is acceptable.
    4. IOHOST offer large numbers of mailboxes with some account types subject to a fair use policy. Mailboxes are intended for direct use by the package owner and should not be resold or offered for use by third parties. Should the number of active mailboxes assigned to an individual package exceed 49, IOHOST reserve the right to restrict the number of mailboxes included in the package price.
    5. IOHOST reserve the right to delete mailboxes (including contents) that are deemed inactive, i.e. have not been accessed within the last 180 days.
    6. IOHOST will suspend access to, or cancel, an account which:
      1. Contains invalid or fraudulent details.
      2. Initiates a payment card chargeback.
    7. You agree;
      1. not to re-sell or offer for the use of third parties any part of our services, unless you have purchased a reseller package or dedicated server.
  2. Acceptable use guidelines
    1. You may not use the Services:
      1. in any way that breaches any applicable regulation , UK or International law.
      2. in any way that is fraudulent;
      3. to host any material which is in breach of our content guidelines (see section 3);
      4. to transmit, or otherwise permit any unsolicited or unauthorised advertising or promotional material or any other form of similar marketing material ,also known as SPAM or Unsolicited Commercial E-mail (UCE)
      5. to publish or otherwise distribute Warez, copywritten or other illegal material. The onus is on You the customer to prove that You own the rights to publish material, not for Fasthosts to prove that You do not.
      6. to participate in any file-sharing/peer-to-peer activities;
      7. as a file backup store. All files uploaded to a domain on our servers must be visible and accessible by visiting that domain, unless they are hidden files needed to operate the website; we reserve the right to delete files which do not match these criteria without giving notice to you.
      8. to use the server as an application server. Using the server to generate large volumes of email from a database is an example of activity that is not allowed. Scripts should not attempt to manipulate the timeouts on servers. These are set at the present values to ensure the reliability of the server. Sites that reset these do so because they are resource intensive, and adversely affect server performance and are therefore not allowed. Scripts that are designed to provide proxy Services, anonymous or otherwise, are not allowed.
      9. to use an excessive amount of server resources. These include bandwidth, processor utilization and / or disk space.
      10. to offer HTTP downloads from your site, other than where the files are directly related to the subject matter of the site. We recommend you stream any multimedia content including audio and video files. Any downloads offered by You under this clause are subject to sections 1.2, 2.1.6, and 2.1.10 of this Acceptable Use Policy. IOHOST hosts reserves the right to archive any download content we do not believe to be necessary for the normal operation of the site, and the definition of this is entirely at the discretion of IOHOST .
      11. to redirect users from a non-.XXX website to a .XXX website
  3. Content guidelines
    1. These content guidelines apply to any and all services provided by IOHOST to You.
    2. Material published to or transmitted through our servers must:
      1. be accurate (where stating facts);
      2. comply with applicable law in accordance with section 2.1.1 of this policy.
    3. Material must not:
      1. be defamatory of any person;
      2. be obscene, offensive, or inflammatory;
      3. contain any adult material with the exception of content hosted on .XXX domains. Adult material includes all pornography; or otherwise lewd or obscene content. The designation of ‘adult material’ is left entirely to the discretion of IOHOST.
      4. material hosted on .XXX domains must not breach any of the IFFOR policies. These include, but are not limited to:
        1. .XXX registrants must not display any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, depicting child pornography as defined in the United Nations Convention on the Rights of the child.
        2. .XXX registrants must agree to permit automated monitoring of their sites by IFFOR or if applicable, any other recognized third party for compliance with IFFOR policies, including without limitation, IFFOR policies requiring site labelling, prohibiting child pornography, and prohibiting content or conduct designed to suggest the presence of child pornography. Registrants must agree not to employ technological or other means to defeat or prevent such monitoring.
        3. No registrant shall use or permit use of a .XXX domain name for or in connection with email spoofing, phishing, spam, or other forms of malicious behaviour, in accordance with specifications and policies issued by IFFOR from time to time.
        4. No registrant may register an abusive string in the sTLD including, without limitation, strings that infringe the intellectual property rights of a third party, including common law trademark rights; strings that are obvious variants of well-known trademarks not belonging to the registrant; first and last names of an individual other than the individual or his/her agent or names that suggest the presence of child pornography.
      5. infringe any copyright, or trade mark.;
      6. be likely to deceive any person;
      7. promote or assist any illegal activity;
      8. be threatening, abusive or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
      9. be used to to misrepresent your identity or affiliation with any person or organization;
    4. You must ensure that any end-user submitted content such as forum posts or chat room entries meet with the standards defined within this Policy.
  4. Enforcement
    1. We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of IOHOST Services. When a breach of this policy has occurred, we may take such action as we deem appropriate in accordance with section 1.1 of this Acceptable Use Policy.
    2. Failure to comply with this Acceptable Use Policy constitutes a material breach of our Terms and Conditions upon which you are permitted to use IOHOST Services, and may result in our taking all or any of the following actions:
      1. immediate, temporary or permanent withdrawal of your right to use IOHOST Services;
      2. coimmediate, temporary or permanent removal or archiving of any content in breach of our Content Standards (as defined in section 3 of this Acceptable Use Policy) uploaded to our servers;
      3. issue of a warning to you;
      4. issue of legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
      5. further legal action against you; or
      6. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
    3. We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
  5. General
    1. IOHOST have a Police Liaison function and we are committed to assisting, and cooperating with, all law enforcement and government agencies in helping to reduce Internet Crime.

    1. We are happy to answer any questions You may have regarding Your IOHOST Services. Please note that any discussions with IOHOST are treated in strictest confidence, so we may need to ask You security questions to confirm that we are speaking to the right person.

    1. Your right to privacy is very important. IOHOST recognize that when You choose to provide IOHOST with information about Yourself, You trust IOHOST to act in a responsible manner. We believe this information should only be used to help IOHOST provide You with a better Service. Agreement of Contracts

A contract is considered signed in the event of services being taken with no formal signature being offered or filed. A cool off period of 14 days applies to any new business where either party can withdraw services within this period. By taking services after the 14th day you agree to the terms and conditions set out herein and contained on this site.

We retain the right to alter/change/remove at any point terms offered in this contract without prior notice or notification.


Complaints Escalation

Submitting a complaint via the website

  1. Log into the Support Center of the website.
  2. Click Open a New Ticket
  3. Input contact information
  4. Select the Help Topic as “Feedback”

A representative will reply to your complaint within 7 days, we reserve the right during this time to withhold files and services with no refund for loss of service or business.


Public Liable

We take a zero tolerance policy to adverse comments made public about IOHost or any of its directors on social media or other outlet. We actively seek to weed out internet bullying and govern ourselves by the guidelines set out in UK Law, more information.

Where we encounter cases of bullying on our platform or on social media we will report any and all cases and bring about liable cases where the evidence is considered substantial and can be verified.

We aim to resolve matters in a professional manor by adhering to the policies and guidelines that govern our trade.


Terminating Services

  1. Misuse – We reserve the right to terminate your services on our platform due to misuse or for any behaviour that we deem as unsuitable for our services.
  2. Non Payment – We reserve the right to terminate your services on the 14th day of your due date if no payment has been received on the anniversary of your services. (Fee’s apply)
  3. Moving Away – We reserve the right to terminate your services should your domain or email be redirected towards a new service provider without notice given of your intention to move away. (Fee’s apply). In the event the client has taken new services and the domain registration has been auctioned on behalf of the client we retain the right to withhold DNS/Transfer until all invoices have been paid.
  4. To terminate your hosting agreement with IOHOST you are required to provide notice of doing so; this notice should be in the form of a written email or support ticket submitted to our help desk on this site. In the event your termination request is after the anniversary or renewal date you will be liable for time on service and upon an official cease request you will be invoiced for this time. Domain names are renewed ahead of renewal and will run until their ultimate expiry as per the Whois records held by ICANN, NOMINET or other registering body. We do not have the ability to terminate your domain name registration as this is not possible via the registrar.
  5. IOHOST will not be held responsible for loss of earnings or reputation should a website be terminated in any manor. We absolve ourselves as a sole trader or business entity from liability for your business operations and public image.

Subscriptions & Payment

  1. In taking services with IOHOST you are agreeing to a subscription to run no less than twelve (12) calendar months from the point of initial payment.
  2. Continuous Payment authority will be applied for using the Credit/Debit card used to pay the last invoice amount. Your service will automatically be renewed on the anniversary of the setup of your account, an invoice will be generated and sent 14/30 days prior to the payment being applied for.
  3. Your chosen payment type will remain on the billing system to the expiry of the Credit/Debit card.
  4. We reserve the right to perform fraud checks and enquire to the source of funding with your bank.
  5. Charge Backs/Failed payment attempts will be charged at 0.25% of the transaction value and be applied to the next invoice period where services have been provided without cleared payment.

Termination Fee’s

Non Payment of renewal – The client will be billed for any days past the generation of the original renewal invoice limited to 14 days of service. A one off administration fee of £26.00 will be applied for after 30 days added to the 14 days of service invoice.

Moving Away – Any time spent transferring files or “web work” will be charged at £80 per hour billed in whole hours.


Non Payment

We reserve the right to bring about court claims where a invoice has not been paid in its completeness where funds are due to the service. We reserve the right to apply for administrative fees and any other fees for the administrative work required to recover outstanding funds.


Content Ownership

In the event of a website being designed or created for a client it is done so under license only. IOHOST retains all right and ownership over the content and information contained within a hosting account. The site and all operating files are retained by IOHOST and are considered property of IOHOST. Data contained within your hosting account including but not limited to information created by third parties are property of IOHOST and the data controller in these matters is considered as “Iohost”. Emails on the platform are not considered our property however access to this information where contained in our services is retained and subject to the correct running and funding of the hosting account. In the event of non payment of services we retain the right to cease access to this information.

In summary we consider the following to be our property at all times.

  1. Website files – Including operating files, configuration files.
  2. Databases – All databases including information contained within.
  3. Control Panel access – Any or all operating files of the service hosted on our servers for the purpose of providing your account.
  4. Graphical assets – Any or all digital assets that have been recreated on our system or uploaded/cropped/scaled or edited using the hosting platform to create new digital assets.
  5. Any or all files/configurations utilized in backups no matter the location of where they reside.
  6. Domain registration – Where a domain has been registered on our service on behalf of the client we will retain ownership of that domain until its expiry. Should you require this moving to a new service we will manage DNS records on behalf of the client on retention until any or all invoices are satisfied.

Licensing

You as the client are responsible in ensuring that the account is maintained and funded as per the renewal cycle, should you wish to cease your account it you are required to give 30 days notice by way of support ticket, during this notice period you are encouraged to save/download your emails and contact us for licensing of your website or any assets should you be moving them to a new provider.

In the event that the “client” moves services taking digital assets utilized on our platform and the digital signature or checksum can be verified should a license not be in place we will issue a D.M.C.A take down notice for copyrighted materials, failure to remove this from your new provider will result in legal proceedings.


G.D.P.R

G.D.P.R requests can be made to support@iohost.co.uk and must be done so within 30 days of a terminated or suspended account being set as such. After 30 days your information is removed from our platform and we will not hold any further information about you “the client”.
